Limitation of Liability
Therapy Billing Company, LLC (“Company”) provides revenue cycle management services based solely on the documentation, information, and representations provided by the Client.
The Client acknowledges that reimbursement determinations, audits, recoupments, payment reversals, take-backs, and claim denials are made at the sole discretion of the applicable payer and are outside the control of the Company.
In the event of any audit, recoupment, repayment demand, or reimbursement adjustment by a payer, the Company’s total liability, if any, shall be strictly limited to the total service fees actually received by the Company in connection with the affected claims.
Under no circumstances shall the Company be liable for consequential, indirect, incidental, special, or punitive damages, including but not limited to lost revenue, lost profits, penalties, interest, or repayment amounts exceeding the service fees paid to the Company.
The Client remains solely responsible for clinical documentation, coding accuracy, medical necessity determinations, and regulatory compliance unless otherwise expressly agreed in a separate written agreement.
